The Madras High Court commented that the Wife As Homemaker indirectly contributes to the husband’s earnings. Therefore, the Madras High Court clarified that the wife has an equal share in every property acquired by the husband. Justice Krishnan Ramasamy ruled in favor of a woman who approached the court seeking an equal share in the assets in her husband’s name. Several key comments were made as part of the judgment.
Justice Krishnan Ramasamy held that there is no law in India directly or indirectly recognizing the participation of wives in the family system. It is said that the wife indirectly contributes to the husband’s difficulty in acquiring family assets. He said that the husband can work without stress because the wife takes care of the housework and their responsibilities at home. It is explained that the wife is indirectly sharing in the husband’s earnings by relieving the pressure of household responsibilities. Justice Krishnan Ramasamy said that even though there are no laws in this regard, this court recognizes the hardship of the wife.
Justice Krishnan Ramasamy said that after decades of taking care of the family and children, the Wife As Homemaker has nothing left to claim as her own. Justice Krishnanramasamy said that both the husband and wife work equally hard for the welfare of the family, and both the wife and husband have direct and indirect labor in earning property. In this order, Justice Krishnan Ramasamy ruled, that the wife should be given an equal share in the assets in the name of the deceased husband. The judge who heard the petition filed by a housewife named Ammal passed the verdict.
